1. Acceptance of Terms
   By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Service Description
   GetSummer.ai provides a feature that adds a button to your website. When a user clicks on this button, our Service generates a summary of the content provided on that page. 

3. License

   1. License to use Summer
      Subject to your compliance with these Terms, Summer grants you a non-exclusive, non-transferable, revocable license to use the GetSummer.ai application, including any widgets and buttons associated with the Service, solely as necessary to use the Service on your website for your personal or business purposes. This license does not include any right to resell the Service, make any derivative use of the Service, or use any data mining, robots, or similar data gathering and extraction tools.

   2. Content
      By integrating our Service with your website, you grant us a non-exclusive, worldwide, royalty-free license to access, use, reproduce, modify, display, and distribute the content on your website for the purpose of providing the summarization service.

   3. Intellectual Property
      You retain all rights to the original content provided on your website. The summaries generated by our Service are derived from your content, and you grant us the license to create and use these summaries as part of our Service.

4. Restrictions
   You are specifically restricted from all of the following:

   1. Using the Service in any way that is, or may be, damaging to the Service or to any person or business entity.

   2. Using the Service in any way that impacts user access to the Service.

   3. Using the Service contrary to applicable laws and regulations, or in a way that causes, or may cause, harm to the Service, or to any person or business entity.

   4. Engaging in any data mining, data harvesting, data extracting, or any other similar activity in relation to the Service, or while using the Service.

5. Paid Plans and Pricing

   1. Subscription Plans
      GetSummer.ai offers various paid subscription plans as detailed on our pricing page at https://getsummer.ai/pricing. Each plan includes different features and limitations, which are described on the pricing page. You are encouraged to review the details of each plan before choosing the one that best fits your needs.

   2. Fees and Payment
      By selecting a paid plan, you agree to pay the subscription fees at the current rates as listed on our pricing page. Payment is due at the beginning of each subscription period, and will automatically renew at the end of each period unless you cancel your subscription through your account settings.

   3. Changes in Pricing
      Summer reserves the right to modify, increase, or decrease the pricing of our subscription plans at any time. Any price changes will be effective following the posting of such changes on the GetSummer.ai pricing page, and will apply to any subsequent subscription periods. We will provide you with reasonable prior notice of any change in subscription fees to give you an opportunity to cancel your subscription before the change becomes effective.

   4. Notification of Changes
      We will notify you of any changes in pricing by posting the new pricing on the GetSummer.ai pricing page and/or by sending you an email notification. It is your responsibility to regularly check the pricing page for any changes.

   5. Cancellation and Refunds
      You may cancel your subscription at any time through your account settings. Upon cancellation, you will continue to have access to the Service until the end of your current paid subscription period. Summer does not provide refunds for any partial subscription periods or unused services. The only exception to this policy will be clearly specified either within the application interface of GetSummer.ai or on the pricing page of our website at https://getsummer.ai/pricing . Any exceptions to our refund policy will be communicated clearly and must be agreed upon at the time of purchase.

If we suspend or stop providing the Service in a way that fundamentally impacts your use of the Service, you will be entitled to a pro-rata refund for the period during which the Service was not fully available to you.

6. Upgrades and Downgrades
   You can upgrade or downgrade your subscription plan at any time. If you upgrade, the new rate will take effect immediately, and you will be charged the prorated difference for the current billing cycle. If you downgrade, the new rate will take effect at the beginning of the next billing cycle.

6. No Warranties
   This Service is provided "as is," with all faults, and Summer expresses no representations or warranties, of any kind related to this Service or the materials contained on this Service.

7. Limitation of Liability
   In no event shall Summer, nor any of its officers, directors, and employees, be held liable for anything arising out of or in any way connected with your use of this Service whether such liability is under contract, tort or otherwise.

8. Indemnification
   You hereby indemnify to the fullest extent Summer from and against any and/or all liabilities, costs, demands, causes of action, damages, and expenses arising in any way related to your breach of any of the provisions of these Terms.

9. External Links and Third-Party Content
   Our Service may contain links to external websites that are not provided or maintained by or in any way affiliated with Summer. Please note that Summer does not guarantee the accuracy, relevance, timeliness, or completeness of any information on these external websites.

Our Service may display, include, or make available third-party content (including data, information, applications, and other products or services) or provide links to third-party websites or services ("Third-Party Content"). You acknowledge and agree that Summer is not responsible for any Third-Party Content, including their accuracy, integrity, quality, legality, usefulness, or safety. We expressly disclaim all liability arising from your use of any Third-Party Content, and you agree that your use of Third-Party Content is at your own risk.

Summer does not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any content or communications posted via the Service or endorse any opinions expressed via the Service. You understand that by using the Service, you may be exposed to content that might be offensive, harmful, inaccurate, or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. Under no circumstances will Summer be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Service or broadcast elsewhere.

10. Severability
    If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

11. Variation of Terms
    Summer is permitted to revise these Terms at any time as it sees fit, and by using this Service you are expected to review these Terms on a regular basis.

12. Assignment
    Summer is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

Entire Agreement
These Terms constitute the entire agreement between Summer and you in relation to your use of this Service, and supersede all prior agreements and understandings.
